Divorce Attorneys in Jacksonville
Serving Jacksonville, Jacksonville Beach and clients throughout Florida
Even the most amicable divorces can be complex and should involve an experienced family law attorney. Divorces are complicated, regardless of how much you and your spouse agree with each other. There are forms to file, deadlines, and a lot of information the courts must sort out to officially end your marriage.
But before you worry too much about the legal process, it’s important to first understand what divorce really entails.
General Information on Divorce
Marriage is a legal relationship between two individuals and is recognized by both society and the State. Individuals are required by law to obtain a marriage license from the Clerk of Court in order to legally marry. The State will only recognize a legal marriage when a valid marriage license is issued.
In the state of Florida, “Divorce” itself is a common word for the legal term “dissolution of marriage,” and the terms are often used interchangeably. In 1971, the Florida Legislature enacted the dissolution of marriage law.
Additionally, under Florida state law, only one partner in the marriage is needed to declare that the marriage is “irretrievably broken.” The idea behind the Florida “no fault” concept of divorce attempts to eliminate disclosure of private matters.
Additionally, there are two kinds of divorce: contested and uncontested. A contested divorce is a divorce in which the parties are not able to reach an agreement surrounding marital assets such as property, investments, and parental responsibility. In an uncontested divorce the parties agree on all issues.
